P PlaintiffstatedclaimunderADAbasedonallegationthathewasdeniedaccesstospecialshockincarcerationprogrambecausehewasHIV+amputee.Courtalsoheldthatallegationsthatprisonofficialsfailedtoprovidehimwithadequatewheelchairforfivemonths,despitereceivingnotificationthatinmatewasinpainandinmate'sgrievancesconcerningconfiscationofhispersonalwheelchair,alongwithallegationsthatinmatesufferedseverebackpainandcuttohisheadasaresultofsuchfailure,supported1983claimsagainstofficialsforfailuretoprovideadequatemedicalcareinviolationofEighthAmendment.Allegationsthatsuperintendentdirectlyrefusedtoallowinmate'spersonal,customizedwheelchairtoberepairedandordereditsconfiscationweresufficienttosatisfyrequirement,under1983,thatinmateshowpersonalinvolvementofsuperintendentanddirectorinallegedunconstitutionaldenialofadequatemedicalcare.HallettwasapparentlytoldbyGreenHavenofficialsthatthemetalrimsandspokesofhispersonalwheelchairposedasecurityrisk.Inresponsetothecorrectionalfacility'sconcerns,onMarch16,1998,HallettrequestedthatGreenHavennurseauthorizethepurchaseofplasticpartsthatwouldconformtosecuritystandards.SherefusedtoauthorizethereplacementpartsbutdidnotconfiscateHallett'swheelchair.Def.ArtuzthenconfiscatedHallett'swheelchair,providinghiminsteadwitha"standard-issue"DOCSwheelchairthathadneitherafixedframenormovablefootandarmrests.Harrelsonv.CityofMillbrook,859F.Supp.1465(M.D.Ala.1994).Paraplegicinmatebrought '(#- actionagainstjailfordeprivinghimofhiswheelchairandnotprovidingahandicapaccessiblebathroom.ThecourtheldthatplaintiffstatedaclaimunderTitleIIoftheADA,butthatpunitivedamagesarenotavailableundertheADA.Hicksv.Frey,992F.2d1450(6thCir.1993).Upholdingdamageawardtoinmatewhowas +'2 completelydependentuponawheelchairforanymobility.Yethewasplacedinacelltoosmalltoaccommodatehiswheelchair,andthusforaboutthreemonthswasconfinedtoabunkwithnoopportunitytomoveaboutorexercisehisinjuredlimbs.Further,hehadproblemscontrollingurinationandbowelmovements,yethadnoaccesstoashowerwhileintheisolationcell.Hughesv.JolietCorrectionalCenter,931F.2d425,428(7thCir.1991).Courtreversedthe  dismissalofaprisoner'scomplaintwhereheallegedthatprisonofficialshaddeniedhimaccesstohiscrutchesandlegbraceforcinghimtowalkwithouttheminordertogettothetoilet.Johnsonv.HardinCounty,Ky.,908F.2d1280,1283-84(6thCir.1990)(EighthAmendment    claimbasedinpartonjailers'refusaltoprovideinmatecrutchesprescribedbydoctor;jailersinsteadtoldplaintifftostayoffhisfeetasmuchaspossible)Jonesv.St.TamanyParishJail,(1999WL219769(E.D.La.)).(Denyingsummaryjudgmentto (  Sheriffwhodeniedprisonerawheelchair.Factualissuesindisputeincluded(1)whetherthewheelchairwasdeniedduetoamedicaldecisionortheSheriff'sfailuretomaintainanadequatesupplytoaccommodatedisableddetainees;and(2)whetherprovisionofawheelchairrequiresamedicalprescription.Journeyv.Vitek,685F.2d239,242(8thCir.1982).ApplyingtheRehabilitationAct,theCourt  ofAppealsaffirmedthefindingsoftheDistrictCourtthataparaplegicprisonerconfinedtowheelchairhadnotbeenexcludedfromparticipationineducational,rehabilitative,recreationalandemploymentprogramsbecause"prisonpersonnelhaveafforded(Journey)accesstotheactivitiesinwhichhehadinterest,nearlyasoftenashewantedtoparticipate."Kaufmanv.Carter,952F.Supp.520,(W.D.Mich.1996).Plaintiffwasabilateralamputeewho 8 usedawheelchairand,onoccasion,walkedwiththeaidofprostheses.HeallegedviolationsoftheADAandRehabilitationActbasedoninaccessibleshowers,toilets,andothernecessitiesintheKalamazooCountyJail.Specifically,theshowerwastoonarrowtoaccommodatehiswheelchair.Also,becauseitlackedhandrailsandnon-slipflooringmaterials,hefacedgreatdifficultyintransferringhimselffromhiswheelchairtotheshowerbench.Heclaimsthatthisarrangementcausedhimtofallatonepointwhileattemptingtousetheshower.Asaresult,hewastakenbyambulancetoalocalemergencyroomanddiagnosedashavingpulledabackmuscle.πPlaintifffurtherclaimshewasunabletomaintainproperhygieneduetohisdifficultieswiththeshower,andwasharassedbycellmatesduetohisodor.PlaintiffalsoassertsthatthetoiletinSickBayNo.3wasinaccessibletohimbecauseitlackedbothhandrailsandaseat,andwassetintoanarrowstallintowhichhecouldnotmaneuverhiswheelchair.Heclaimsthatonoccasionheeitherfelltothefloorwhileattemptingtotransferbetweenhiswheelchairandthetoilet,orfelldirectlyintothetoiletwater,whichrequiredhiscellmatestopullhimoutofthebowl.Theseevents,heasserts,lefthimbruisedandhumiliated.Heclaimsthatthecell'sdrinkingfountainandsinkwereinaccessibletohim,andthattheirdesignoncecausedhimtofallwhileattemptingtogetadrinkofwater.Healsoclaimsthathecouldnotreachthetelephonewithoutassistancefromfellowinmates.Plaintiffallegesthatheinformeddefendantnursesofeachoftheseinadequacies,tonoavail. developeddecubitusulcersbecausejail'spoliciesandpracticespreventedhimfromreceivingadequatecareinviolationofhisrighttobefreeofcruelandunusualpunishmentundertheEighthAmendment.AlthoughnursewarnedSheriff'sDepartmentthatplaintiffneededtobeinahospitalsetting,herwarningsweredisregarded.Hewasgiveninadequatebedding,medicationsweredenied,hereceivednoassistanceincleaninghimself,didnotseeadoctorforweeks,andnursingstafffailedtochangedressing.Asaresultofallthis,theinmateultimatelyrequiredmultiplesurgerieswithlittlepotentialforfullrehabilitation.Laynev.Superintendent,MassachusettsCorrectionalInstitution,CedarJunction,406Mass.156, 159(1989).Prisonerwhousedwheelchairentitledtoaccesstolawlibraryunderstateconstitutionalprovisionprotectingpersonswithdisabilities.Lovev.WestvilleCorrectionalCenter,103F.3d558(7thCir.1996).Thecourtaffirmedajury h  awardofapproximately$30,000toaquadriplegicprisonerwhowasdeniedaccesstoprogramsandservicesintheIndianaStatePrison.LovewashousedinWestville'sinfirmaryunit.Thismeant,amongotherthings,thathewasunabletousetheprison'srecreationalfacilities,itsdininghall,thevisitationfacilitiesthatwereopentothegeneralinmatepopulation,andthathewasunabletoparticipateinsubstanceabuse,education,church,work,ortransitionprogramsavailabletomembersofthegeneralinmatepopulation.Inaddition,hisaccesstothelawlibrary,theregularlibrary,andthecommissarywaslimited.Courtgaveseveralotherexamplesofdiscrimination,SundaychurchserviceswerenotavailableinLove'sunit,A2-South,butsuchserviceswereofferedinthemainquartersoftheprison.LovewasdeniedaccesstoagroupsubstanceabuseprogrambecausenonewasavailableforA2-South,eventhoughtheprogramwasavailableinthemainquarters,Love'scounselorhadrecommendedheattendit,andhehadaskedtoparticipate.Collegeclasseswerealsoonlyavailableinthemainquarters,notinA2-South.πLoveoffersahostofotherexamples,butthesesufficetoshowthathewasdeniedaccesstoavarietyofprogramsavailableatWestville.Maclinv.Freake,650F.2d885(7thCir.1981).Paraplegicinmatewhoreceivednophysical 8 therapyforan11monthperiodstatedaclaimundertheEighthAmendment.Martinezv.CaliforniaDepartmentofCorrection,1997WL207946(9thCir.(Cal.))(unpublished @" disposition).Quadraplegicprisonerwasrestrictedbyprisonauthoritiestothehospitalareaoftheprison.HesuedundertheADAseekingaccesstotheprison'sgeneralyard,classroomeducation,andvocationaltrainingprogramsonthesametermsasothersimilarlyclassifiedinmates.Thecourtaffirmedthedistrictcourtdecisiongrantingsummaryjudgmenttotheprisonofficials.CitingTurnerv.Safley,482U.S.78,89(1987),thecourtheldthattherestrictionswere (#x' reasonablyrelatedtolegitimatepenologicalinterestsinsecurityinthattheplaintiffconcededthathecouldnotdefendhimselffromattackbyotherinmates.JudgeWigginsdissentedstatingthatitisnotrationaltopreventmisconductbypunishingthepotentialvictimratherthanthosewhomisbehave.Millsv.Lee,2000WL972841(10thCir.July14,2000).Disabledfatherofprisonerwasdenied useofhiswheelchairandnotprovidedprisonwheelchairwhenhevisitedhissoninfederalprison.Courtheldthiswasatbestatortcase.SovereignimmunityprotectedFederalGovtfromdamagesunderRehab.Act.Millerv.Tanner,196F.3d1190(11thCir.1999).Prisonerallegedthatprisonstaffwere indifferenttohismedicalneedsasaparaplegicwithaneurogenicbladder.Insteadoftreatinghim,theyhousedhiminanunaccommodatedunit,lefthimontheconcretefloorofhiscell,allowedhimtobecomecoveredinfecesandurine,deniedhimtheuseofawheelchairorlegbraces,anddeniedhimphysicaltherapy.CourtofAppealsreverseddistrictcourt'sdismissal,holdingthatprisonerhadcompliedwiththePrisonLitigationReformActrequirementthatheexhaustadministrativeremedies.Moorev.Farrier,984F.2d269(8thCir.1993).Prisonneednotprovidewheelchairbound claimeddefendantsallprisonofficialsviolatedhisrightsby(1)confiscatinghisshowerwheelchair;(2)failingtodevelopandimplementanexerciseprogramwithproperequipmentforhisneeds;and(3)maintainingafacilitythatwasnotcompliantwithADAregulationsbecauseitlackedshowersafetydevices,anditsdiningandgamingtables,chapel,andrecreationyardhadaccessibilityproblems.CourtheldthatprisonerfailedtostateaclaimundertheEighthAmendmentbecauseinmatefailedtoshowthatdefendantsdeniedhimminimallifenecessities,orthattheyweredeliberatelyindifferenttohishealthorsafety.Thecourtalsorefusedtopermittheprisonertoamendcomplainttoaddinstitutionaldefendantsbecauseofthe11thAmendment.Newmanv.Alabama,349F.Supp.278(M.D.Ala.1972),aff'd503F.2d1320(5thCir.1974). bothcolostomyandurostomybag,allegedthathewasdeniedaccesstosufficientwatertocleanhimselfandwasdeniedcarenecessarytopreventpressuresoresfromforming.ThecourtdismissedRehabilitationActclaimforfailuretoallegethatthejailreceivedfederalfunds.However,itheldthatplaintiffhadstatedaclaimundertheADA,rejectingtheargumentthathewasrequiredtoexhaustadministrativeremedies.Owenv.ChesterCounty,2000U.S.Dist.LEXIS710(D.Pa.).Justpriortohisincarceration,  foruseinhiscellandshower.Courtruledthatsincehecouldnotsupplyhisownchairorinstallgrabbarsinhiscellorprovidehisownbenchintheshower,thendefendantsshouldhave"accommodated"hisconditionbyallowinghimtoremaininahandicapped-accessiblecellorhaveachairinhiscellandtheshowerroom.Otherwise,theregulationsrequiring"reasonableaccommodationsinpolicies,"28C.F.R.35.130,wouldhavenoeffectatall,Raineyv.CountyofDelaware,2000WL1056456(E.D.Pa.)Inmatestatedclaimthathewas discriminatedagainstinviolationoftheADAbecauseasanincompleteparaplegic,hewasabletowalkslowlyandonlywiththeaidoflegbraces.Asaresult,hewasdeniedfoodandmedicaltreatmentbecausethedefendantsallowedhimonlyalimitedamountoftime--sometimestoolimited--totraveltothediningroomandthedispensary.Rosalesv.Coughlin,10F.Supp.2d261(W.D.N.Y.1998).Prisonerwhohadbackandleg   problemsallegedthatcorrectionsofficerrepeatedlyseizedacanethathadbeenprescribedbyprisondoctorandthatotherofficersrefusedtodoanythingaboutit.Whileattemptingtowalktotheshowerwithouthiscane,hecollapsedandsufferedaconcussionandseverebackpain.Courtdeniedsummaryjudgmenttothedefendantofficersongroundsthatsuchconductdeprivesaprisonerofhisconstitutionalrighttomedicalcare.Inasubsequentopinion,50F.Supp.2d185(W.D.N.Y.1999),defendantspresentedanaffidavitfromadoctorstatingthattheinmatedidnothaveamedicalneedtouseacane.Thecourtruledthatalthoughjurymightfindthedoctor'sopiniontobepersuasive,itcouldjustaswellconcludefromtheevidencethattheinmatewasinseriouspain,thatitwasapparenttotheofficersthatheneededthecane,andthattheyexacerbatedhispainbyseizingthecane.Schmidtv.Odell,64F.Supp.2d1014(D.Kans.1999).Formercountyjailinmate,adouble '`", amputeewithoutbothlegsfromapointbelowhisknees,broughtcivilrightsactionagainstjailofficials,assertingclaimsundertheEighthAmendment,theAmericanswithDisabilitiesAct,andtheRehabilitationAct.Heallegedthatduringhisincarcerationthedefendantsdeprivedhimofawheelchairorotheraccommodationandforcedhimtocrawlandpullhimselfaboutthejailonthefloor.Jaildidallowhimtousetheprosthesesthathehaduponarrival,butthesebecamedamagedandunusable.Medicalpersonnelrecommendedawheelchairwhichwasdeniedbecause +'2 jailersclaimedtheentrancesandexitstothecellsaretoonarrow,thechaircouldbeusedtoblockthecellblock,theotherinmateswouldplaywiththewheelchair,thewheelchaircouldbeusedtohidecontraband,andthewheelchaircouldbedisassembledandmadeintoaweapon.Hewasgivenkneepadsinstead.Thiscausedlegstoswellmakingitdifficulttofitnewprostheses.Thecourtpointedoutthattherearenowrittensecuritystandardsfromanygovernmentagencyorassociationofanykindconcerningthesafetyrisksofwheelchairsinajail.Thejailhasneverhadanywrittenguidelinesondealingwithaprisonerinawheelchair.becausedoorwaystoonarrow.ItheldthatthefailuretoprovideawheelchairdidnotbyitselfviolatetheEighthAmendmentbecausethejailcouldnotaccommodatewheelchairsandthejailershad"legitimatesecurityconcerns"aboutplacingawheelchairingeneralpopulation.Nonetheless,theabilityoftheplaintifftomovehimselfaboutthejailinanappropriatemanner--tousethetoilet,tousetheshower,toobtainhismeals,andtoobtainsuitablerecreationandexercise--wasabasicneed--partofthe"minimalcivilizedmeasureoflife'snecessities"--thatthedefendantswereobligatedtohelpprovideundertheEighthAmendment.Inaddition,plaintiffstatedclaimundertheADA.Shakkav.Smith,71F.3d162(4thCir.1995).Deprivationofprisoner'swheelchairforone-day h  periodatdirectionofprisonpsychologistdidnotconstitutedeliberateindifferencetoseriousmedicalneedsofprisoner,and(2)refusaltoallowprisonertotakeshowerforthreedaysafterhumanexcrementwasthrownonhimdidnotconstitutecruelandunusualpunishmentasdefendantwasgivenmaterialstocleanhimselfandcell.PsychologistbelievedthatremovingallstimuliandmaterialsthatcouldbeusedinaviolentmannerwouldquietShakka.Inparticular,hesoughttopreventShakkafromdisassemblinghiswheelchair,ashehadtheplumbingfixtures,andusingittoharmhimselforothers.Shakkav.Smith,28F.3d1210,1994WL319217(4thCir.(Md.)))Sameinmateasabove,but differentcase.Here,heallegesthatprisonofficialsorderedremovalofhiswheelchairtoforcehimto"getupandwalk,"andthattheyalsodeliberatelyplacedfoodoutsidehisreach.ThecourtheldthatevenifShakka'sparalysiswaspsychological,itcouldbeasufficiently"serious"medicalneedsuchthatdenialofthewheelchairmightviolatetheEighthamendment.Shariffv.Artuz,2000WL1219381(S.D.N.Y.))Plaintiffswerehousedinprisonunitfor  p physicallydisabled.Theyallegedtheyweredeniedaccesstohonorblockbecausetheyusedwheelchairsandwereunabletoambulate.Thecourtdenieddefendantsmotiontodismissbecauseplaintiffswereotherwisequalifiedforadmissiontothehonorblockbuthadbeendeniedadmissionbecauseoftheirdisabilities.ItalsorejectedtheargumentofprisonofficialsthatplaintiffsrightsweregovernedbyaconsentdecreewhichmandatedprisontoestablishandmaintainanADAcompliantunitforphysicallydisabledandrequiredprisontoattempttoplaceallinmatesinappropriateeducational,vocationalorjobprogramsconsistentwiththepatients'medicalconditions.Thecourtheldthattheconsentdecreewasinappositebecausehonorblockwasnotaneducationalorvocationalprogram.ButthecourtalsoruledthereisnoindividualliabilityundertheADA.Simmonsv.Cook,154F.3d805(8thCir.1998).Paraplegicinmatesbrought1983action againstcorrectionsofficials,allegingEighthAmendmentviolationsarisingfromtheirplacementinsolitaryconfinement.Specifically,theywere(1)wereplacedinsolitaryconfinementforthirty-twohours;(2)weredeniedtheir"eggcrate"mattresses;(3)missedfourconsecutivemealsbecausetheirwheelchairscouldnotmaneuveraroundthecellbunktoreachthebarreddoorwherethefoodtraywasplaced;and(4)wereunabletoeliminatetheirbodilywastes.Courtuphelddamageawardof$2000toeachinmate.Taylorv.Plousis,101F.Supp.255(D.N.J.2000).Prisonerwhohadbothlegsamputated_alleged +'2 thatjailforcedhimtowalkonbrokenprosthesisforsevenmonths.Thecourtdeniedsummaryjudgmentmotionofthedoctorwhowasawareoftheneedforanewprosthesisbutwhomaynothavemadeadequateeffortstoobtainone.Italsodeniedsummaryjudgmenttothenurseandofficerwhoallegedlydeliberatelydelayeddeliveryofplaintiff'sprosthesisuntilhecouldbetransferredtoastateprison.ThecourtgrantedsummaryjudgmenttotheSheriffbecausetherewasnoevidencethathepersonallyknewanddisregardedtheinmate'smedicalneeds.Finally,itgrantedsummaryjudgmenttotheCountyongroundsthattherewasnoevidencethatanyofficialwithfinalpolicymakingauthorityactedwithdeliberateindifferencetotheinmate'sneedforadequatemedicalcare.Terryv.SalinasValleyStatePrison,2000_U.S.App_.Lexis,31186(9thCir.).Correctionalofficer H  1998)(unpublished).Inmatewhousedwheelchairwasinjuredwhentransportedinvanthatwasnotwheelchairaccessible.CourtdismissedADAclaimongroundsthathewastransportedlikeallotherinmatesandthereforenotdeniedanyservice.ADAdoesnotrequirethatdisabledprisonerbegivenbestmeansoftransportation.Weeksv._Chaboudy_,984F.2d185(6thCir.1993).Theprisonerwasparalyzedfromthewaist  downbutwasplacedinaportionoftheprisonwherehewasnotpermittedtohaveawheelchair.Wheelchairswereonlypermittedintheprisoninfirmary.Thedoctor,whohadbeentreatingtheprisonerthroughouthisincarceration,couldhaveauthorizedtheprisoner'stransfertotheinfirmary.Itwasundisputedthatit"wasacceptedpracticetokeepparalyzedinmatesintheinfirmary"since"itwastheonlyareaoftheprisonequippedtocatertotheirneeds"andthatthedoctorknewtheprisoner"wouldnothaveaccesstoawheelchairifnotadmittedtotheinfirmary."Thedoctordidnot,however,admittheprisonertotheinfirmary.Hesimplyconcludedthattheprisoneris"presentlylockedinJBlocksothisnegatestheuseofawheelchairinhisparticulararea.Wewillpursueotheravenuesofconsultationandseeifwecan'tderivesomedispositionofthismanotherthanhereintheinfirmary."Noother"dispositionwasfoundorattempted"bythedoctor.
